Terms and Conditions
Effective Date: 5/01/2025
Welcome to BudgetBonds.com. This website, located at https://budgetbonds.com (“Site”), is operated by Fervor LLC, doing business as Budget Bonds and Insurance Services (“Company,” “Budget Bonds,” “we,” “us,” or “our”).
These Terms and Conditions (“Terms”) govern your use of the Site and its online features. Please read them carefully. By accepting these Terms or using the Site after receiving notice of them, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please discontinue use of the Site.
These Terms do not replace any insurance policy, surety bond, binder, application, indemnity agreement, broker agreement, or other separately executed agreement.
1. Website Use and Eligibility
You may use the Site only for lawful purposes. To submit an application or request services on behalf of yourself or a business, you must be at least 18 years old and have authority to provide the information and make the request.
You agree not to:
Submit information that you know is false, misleading, fraudulent, or unauthorized.
Impersonate another person or misrepresent your relationship with a business.
Attempt to access restricted systems, accounts, or information without authorization.
Introduce malicious software or interfere with the Site’s security or operation.
Copy, collect, or use Site content in a manner that violates applicable law or another party’s rights.
We may restrict access to the Site when reasonably necessary to address misuse, security concerns, or violations of these Terms. Restricting website access does not itself cancel an existing insurance policy or bond.
2. Our Role and Availability of Services
Budget Bonds provides insurance and surety bond agency services. We are not the insurance company or surety issuing your policy or bond.
Products and services are offered only where the relevant parties hold the licenses, appointments, and authority required by law. Availability depends on your location, eligibility, underwriting, and the participating insurer’s or surety’s requirements.
Website descriptions are summaries. They do not include every condition, exclusion, limitation, or eligibility requirement. The applicable policy, bond, endorsements, and other controlling documents determine the actual terms.
3. Quotes, Applications, and Binding Coverage
A quote is an estimate based on the information available when it is prepared. Pricing, eligibility, and terms may change following underwriting, verification, or corrections to your application.
Submitting a form, requesting a quote, sending a message, receiving an automated acknowledgment, or making a payment does not, by itself, bind, renew, change, or reinstate insurance coverage or a surety bond.
Coverage becomes effective only when properly bound or issued by an authorized party and subject to the applicable effective date and conditions. Obtain confirmation of the coverage and effective date before relying on it.
Statements about fast approval, same-day service, savings, or issuance depend on the circumstances and are not guarantees for every applicant.
A certificate of insurance generally provides evidence of coverage; it does not independently amend or expand the underlying policy.
4. Information You Provide
You agree to provide complete and accurate information to the best of your knowledge and to promptly tell us about material errors or changes relevant to your request, application, or coverage.
If you provide information about another person or business, you represent that you have authority to do so.
Inaccurate or incomplete information may affect underwriting, pricing, eligibility, coverage, or claims, subject to the applicable contract and law.
Please review the quotes, applications, policies, bonds, and related documents you receive and promptly report discrepancies. This provision does not eliminate our own legal or professional responsibilities.
Do not send Social Security numbers, payment card details, or other sensitive information through ordinary text messages or unsecured email. Contact us for an appropriate submission method.
5. Communications by Telephone, Text, Email, and Postal Mail
A. Service-related communications
Depending on your request, relationship with us, communication preferences, and applicable permissions, we may communicate with you by:
Telephone calls.
SMS or MMS text messages.
Email.
Postal mail.
These communications may concern inquiries, applications, requested quotes, document requests, appointments, billing, payments, policy or bond servicing, renewal reminders, and other administrative matters.
We will obtain consent where required by law. Providing contact information or accepting these Terms does not, by itself, constitute consent to every type of communication.
B. Marketing communications
We may provide information about insurance products, bonds, promotions, or other services when permitted by law and consistent with your communication preferences.
Where prior express written consent is required for automated marketing calls or texts, or marketing calls using an artificial or prerecorded voice, we will obtain that consent separately.
Marketing consent is not a condition of purchasing insurance, a bond, or any other service from us.
C. Text messaging
If you enroll in text communications, messages will relate to the purposes disclosed when you enroll. Message frequency varies based on your requests and account activity. Your wireless provider’s message and data rates may apply.
Reply STOP to opt out or HELP for assistance. You may also contact us using the information in Section 16 or communicate an opt-out request through another reasonable method.
We may send a single nonpromotional message confirming your opt-out. Delivery depends on your device and wireless network and may be delayed or unavailable. Wireless carriers are not responsible for delayed or undelivered messages.
You must provide a number you are authorized to use and notify us if that number changes or is reassigned.
D. Communication preferences and opt-outs
You may:
Ask us to stop marketing calls.
Withdraw consent to texts or consent-based automated calls.
Unsubscribe from marketing emails using the link in the email or by contacting us.
Request removal from our promotional postal mailing list.
We will honor requests promptly and within applicable legal deadlines. We do not require you to use one exclusive method to withdraw consent.
Unsubscribing from marketing does not cancel your policy, bond, application, or payment obligations. Necessary nonmarketing communications may continue through legally permitted channels, consistent with the scope of your request and applicable law.
E. Electronic delivery and required notices
Routine email or text communication does not automatically enroll you in electronic-only delivery of legally required insurance documents or notices. Where separate electronic-delivery consent is required, it will be obtained separately.
Any statutory or contractual requirements for delivering cancellation, nonrenewal, or other formal notices remain applicable.
F. Call recording
If we record or monitor a call, we will provide any legally required notice and obtain any legally required consent before doing so. Acceptance of these Terms does not replace consent required at the time of the call.
6. Payments, Fees, Cancellations, and Refunds
Premiums, bond charges, agency or broker fees, installment arrangements, and other payment obligations will be disclosed in the applicable transaction documents. Any separate agreement or authorization required by law will be obtained.
Cancellation rights and refund amounts depend on applicable law and the governing policy, bond, fee agreement, and other transaction documents. Some charges may be fully earned or nonrefundable where properly disclosed and legally permitted.
A request to stop communications does not constitute a cancellation request. Contact us for the applicable cancellation procedure and confirmation of its effective date.
7. Surety Bonds and Indemnity Obligations
A surety bond is different from insurance purchased to protect your own business against losses. Depending on the bond, it protects specified parties against obligations covered by the bond.
An applicant or indemnitor may be required to reimburse the surety for payments, costs, or expenses under a separate indemnity agreement.
These Terms do not create or replace an indemnity agreement, and they do not guarantee bond approval or acceptance by a licensing authority, project owner, or other recipient.
8. Renewals, Changes, and Claims
Renewal reminders are provided as a service and do not themselves renew coverage or extend an expiration date. Review the applicable notices and complete any required renewal steps before your policy or bond expires.
Requests to change coverage, limits, named insureds, vehicles, or other policy information require processing and confirmation by an authorized party.
Do not rely solely on a website form, text, or general email inbox for urgent claims reporting or a time-sensitive coverage request. Follow the reporting instructions in your policy or bond and contact the appropriate insurer, surety, or our office promptly.
Nothing in this section reduces any notice, servicing, or other obligation imposed on us by law or a separate agree
ment.
9. Privacy and Submitted Materials
Our Privacy Policy explains our collection, use, and disclosure of personal information.
Submitting an inquiry, application, or supporting document does not give us an unrestricted right to publish it or use it in advertising. Such information will be handled for appropriate business purposes as described in our Privacy Policy and permitted by law.
If you separately authorize us to publish a testimonial, photograph, or review, its use will be governed by that authorization. You retain ownership of materials you submit.
These Terms do not independently authorize a credit inquiry or consumer report where separate permission is required.
10. Intellectual Property
The Site’s original content, design, text, graphics, logos, and other materials belong to the Company or their respective owners and are protected by applicable intellectual property laws.
You may view, download, or print reasonable portions for personal use or for evaluating and obtaining our services. You may not reproduce, sell, modify, or redistribute protected materials for other purposes without permission, except as permitted by law.
Third-party names and trademarks remain the property of their respective owners.
11. Third-Party Websites and Services
The Site may link to insurer portals, payment processors, or other third-party websites and services. Those providers may have separate terms and privacy policies.
We do not control independent third-party websites and do not guarantee their content, availability, or security. This section does not exclude responsibilities that applicable law places on us for selecting, using, or overseeing service providers.
12. Website Information and Availability
We make reasonable efforts to maintain useful and accurate website information, but errors, outdated information, and interruptions may occur.
To the extent permitted by law, the Site and its general informational content are provided “as is” and “as available,” without warranties of uninterrupted access or suitability for a particular purpose.
General website content is not individualized legal, tax, or financial advice and does not guarantee that a particular product satisfies every contractual or regulatory requirement.
These website disclaimers do not alter an issued policy or bond, a separate written agreement, or any duty we owe under applicable law.
13. Limitation of Liability
To the extent permitted by law, the Company will not be liable for indirect, incidental, special, or consequential damages arising solely from use of, or inability to access, the Site.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, violations of law, or any liability that cannot lawfully be excluded or limited.
These Terms do not waive nonwaivable consumer rights or eliminate duties imposed on us in providing insurance or bond services. If applicable law does not permit a limitation stated here, that limitation will apply only to the extent legally permitted.
14. Changes to These Terms
We may update these Terms to reflect changes in our services, business practices, or applicable law. The revised Terms will be posted with an updated effective date.
For material changes, we will provide additional notice or obtain acceptance when required. Changes will apply prospectively and will not retroactively alter an existing policy, bond, separate agreement, or previously accrued claim.
Updating these Terms does not expand an existing marketing consent.
15. Governing Law and General Provisions
These Terms are governed by California law, subject to applicable federal law and any mandatory protections that apply in another jurisdiction.
To the extent legally permitted, disputes concerning these Terms or use of the Site will be brought in a state court in Orange County, California, or a federal court serving Orange County with jurisdiction over the dispute.
This provision does not restrict your right to contact a regulator, use a legally available small-claims procedure, or exercise a nonwaivable right. Disputes under a policy, bond, or separate agreement are governed by the applicable document and law.
If any provision is unenforceable, the remaining provisions will remain effective to the extent permitted by law. A failure to enforce a provision does not waive the right to enforce it later.
